What Vivid DOESN'T Do

We don't:

• Guarantee you'll get interviews or jobs
• Guarantee the AI output is perfect (it might have errors)
• Promise 100% uptime (we're a one-person operation)
• Offer unlimited refunds (see our tiered refund policy below)
• Provide career coaching or advice
• Apply to jobs for you

You're responsible for reviewing everything before you use it.

Your Responsibilities

1. You Must Be Honest

Only submit your actual work history. If you lie, our AI can't help you.

If you submit false information and get caught by employers, that's on you, not us.

2. You Must Review AI Output

Our AI generates suggestions. You make final decisions.

You MUST:

• Read everything before submitting to employers
• Verify all claims are accurate
• Fix any errors or hallucinations
• Take full responsibility for what you send

Think of us like autocorrect - helpful but not perfect. You're still responsible.

3. You Must Use This Legally

Don't:

• Submit someone else's information
• Create fraudulent documents
• Hack or abuse our system
• Resell our service

Violation = immediate account termination, no refund.

Pricing & Credits

How it works:

• Buy credits upfront
• Each credit = 1 customized resume + cover letter
• Credits deduct when generation completes

Current pricing (subject to change):

• 1 credit: $10
• 10 credits: $75
• 25 credits: $175
• 50 credits: $325

Important:

• Credits don't expire (for now)
• Credits aren't transferable
• If generation fails, you keep your credit

5. Refund Policy

5.1 Risk-Free Trial Period

Users may request a full refund within 14 days of purchase if they have used 3 or fewer credits. No questions asked.

5.2 Partial Refunds

Users who have used 4-10 credits may request a 50% refund within 14 days of purchase.

5.3 No Refund After Threshold

Users who have used more than 10 credits are not eligible for refunds, as substantial value has been received from the service.

5.4 Processing Time

Approved refunds are processed immediately. Funds typically appear in the original payment method within 5-7 business days, depending on the user's financial institution.

5.5 Exceptional Circumstances

Vivid reserves the right to issue refunds outside these parameters in cases of service outages, major product defects, or other exceptional circumstances at its sole discretion.

5.6 Refund Abuse

Vivid reserves the right to deny refunds to users who demonstrate patterns of abuse, including but not limited to: multiple refund requests, use of temporary email addresses, or fraudulent payment methods.

What You're Paying For

You're paying for:

• AI processing to generate your resume
• Storage of your data
• Access to the platform
• Peace of mind (14-day money-back guarantee — see Refund Policy above)

You're NOT paying for:

• Guaranteed job outcomes (interviews/offers depend on many factors)
• Perfect AI output (it's usually good, but review it)
• Career success guarantees
• 24/7 instant support (it's just me right now)

Your Data

• Payment info (via Stripe)

What we do:

• Sell your data
• Share your resume with third parties
• Spam you with emails

Intellectual Property

• You own: Your resume and work history
• We own: Our AI system, code, and technology
• AI-generated resumes: Once created, they're yours to use however you want. You don't need to credit us.

Don't try to reverse engineer or steal our technology.

Disclaimers (The Important Legal Stuff)

No Warranties

We provide Vivid "as is" with ZERO warranties.

That means:

• We don't guarantee it works perfectly
• We don't guarantee uptime
• We don't guarantee AI accuracy
• We don't guarantee results

This is beta software. Bugs happen. Errors happen. The AI sometimes makes mistakes.

We're Not Liable for Much

We are NOT responsible for:

• Whether you get interviews or jobs
• AI errors or hallucinations
• Missed application deadlines if our service is down
• Employers rejecting you
• Any indirect or consequential damages

Our total liability is limited to what you paid us.

Translation: If something goes wrong, we'll work with you, but we're not writing checks for lost opportunities. We're a startup exploring if this works.

Legal Version

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVID IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US.

Who Can Use This

You must:

• Be 18 or older
• Provide accurate information
• Use this legally

We're available worldwide, but some features might be limited based on your location.

Account Termination

You Can Leave Anytime

Delete your account in settings. Your data gets deleted within 30 days.

Important: Unused credits are forfeited. No refunds.

We Can Terminate You

We can shut down your account if you:

• Violate these terms
• Act fraudulently
• Abuse the system

If we terminate you, no refunds.

I'm reasonable. Most issues can be resolved with an email.

If That Doesn't Work

For US users:

• Disputes go to binding arbitration (AAA rules)
• Your home state or virtual
• No class actions

For non-US users:

You can opt out of arbitration: Email legal@imvivid.com within 30 days with "Arbitration Opt-Out" in subject.

Changes to Terms

I might update these as I learn what works. I'll notify you 30 days before changes.

Continued use = acceptance of new terms.

General Legal

• Entire agreement: These Terms + Privacy Policy = the complete deal.
• Severability: If one part is invalid, the rest still applies.
• Assignment: You can't transfer your account. I can (e.g., if I sell the company).
• Force majeure: Not liable for things outside my control (disasters, outages, etc.).

International Users

Vivid is US-based. Your data is stored in the US. By using Vivid, you consent to this.

We comply with GDPR (EU) and CCPA (California) where applicable.
